With the ever-increasing costs and greater delays being experienced by those who turn to the Courts for assistance in the protection of their legal rights, alternative dispute resolution and in particular the mediation process represents an efficient, prompt and cost-effective alternative to the formal legal process.

Mediation is a process whereby parties in dispute agree to participate in a meeting presided over by an experienced mediator who is trained to assist those parties towards a workable and acceptable resolution of their differences.

The conference is arranged by the mediator who assumes responsibility for finding a suitable venue, arranging a time which is convenient for the participants and liaising with the legal representatives and any other persons who may be involved in the process.

The mediator brings his or her training and experience to bear to assist the parties to articulate their points of view and to encourage them to appreciate the value of a negotiated settlement rather than an arbitrary determination by some person (e.g a Judge or a Magistrate) being imposed upon them.

When an agreement is reached, the mediator assists in the preparation of any documentation necessary to reflect the terms of the settlement which has been reached.
